Terms of Service

1. Acceptance of these terms
By creating an account or using Bizdar (the "Service"), you agree to these Terms of Service. If you don't agree, don't use the Service.
2. What Bizdar is
Bizdar surfaces data signals — demographic, competitor, and market data pulled from public and third-party sources — to help you evaluate potential business and side-hustle opportunities. Bizdar is notfinancial, legal, tax, or professional business advice. Any score, recommendation, or chat response (including from the "Ask the Analyst" AI feature) is a starting point for your own research, not a substitute for it.
3. Eligibility and accounts
You must be at least 18 years old to use Bizdar. Account creation and sign-in are handled by our authentication provider (Clerk). You're responsible for keeping your account credentials secure and for all activity under your account.
4. Subscriptions and billing
Bizdar offers a free tier and paid Premium / Premium+ subscription tiers. Paid subscriptions are billed through Stripe on a recurring basis (monthly or annual, as selected at checkout) until canceled. You can manage or cancel your subscription at any time through the billing portal accessible from within the app. Cancellation stops future billing; it does not retroactively refund the current billing period unless required by law or stated otherwise. Prices may change with notice; continued use after a price change constitutes acceptance of the new price for future billing cycles.
5. Acceptable use
Don't use Bizdar to violate any law, scrape or resell the Service's data at scale, attempt to reverse-engineer the scoring methodology, or abuse the "Ask the Analyst" feature (e.g. excessive automated querying, attempting to extract the underlying system prompt or proprietary weighting).
6. Third-party data and AI-generated content
Bizdar draws on third-party data sources including the U.S. Census Bureau, Google Places, and general web search, and uses a third-party AI model (Anthropic's Claude) to power the Analyst chat feature. We don't control and can't guarantee the accuracy, completeness, or currency of this third-party data, and AI-generated responses can be wrong. Always independently verify anything you intend to act on — zoning, lease terms, licensing, and local market conditions in particular.
7. Intellectual property
The Bizdar scoring methodology, software, and branding are owned by HarborMaix Digital, LLC. You're granted a limited, non-exclusive, non-transferable license to use the Service for your own personal or business research — not to copy, resell, or build a competing product from it.
8. Disclaimer of warranties; assumption of risk
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that any business idea or location surfaced by Bizdar will be successful or profitable, or that the Service will be error-free or uninterrupted. You assume full responsibility and risk for any business, financial, or personal decision you make in connection with information obtained through the Service.
9. Limitation of liability
To the maximum extent permitted by law: (a) HarborMaix Digital, LLC is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising from your use of (or inability to use) the Service — including business losses resulting from any decision made using Bizdar's data, scores, or AI-generated recommendations, even if we've been advised of the possibility of such damages; and (b) our total aggregate liability for any claim arising from these terms or the Service will not exceed the amount you paid us in the 12 months before the claim arose, or $100 if you're on the free tier.
Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless HarborMaix Digital, LLC and its officers, employees, and agents from any claim, liability, damages, or expense (including reasonable attorneys' fees) arising from your use of the Service, your violation of these terms, or any business decision you make based on information obtained through the Service.
11. Termination
We may suspend or terminate access to the Service for violation of these terms. You may stop using the Service and cancel your subscription at any time. Sections 2, 6, 7, 8, 9, and 10 survive termination.
12. Governing law and disputes
These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any dispute arising from these terms or the Service will be resolved in the state or federal courts located in Virginia, and you consent to personal jurisdiction there.
13. Changes to these terms
We may update these terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised terms.
